Hosting Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website, services, and features provided by Snap SEO (“we,” “our,” or “us”), including our online services, content, and any related features or functionality (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to all of these Terms, do not use our Services.

Please read this agreement carefully. This agreement sets forth the legally binding terms and conditions for your use of the website and the Services.

1. Acceptance of Terms

By accessing or using our Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, our Service Level Agreement (SLA), the terms of use of Cloudways and DigitalOcean, and any additional terms or conditions that apply to specific Services. Certain Services may also require your acceptance of additional terms through a click-through process, such as clicking “I ACCEPT.” If you do not agree to these Terms, you are not authorized to use the Services.

2. Modification of Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will notify you by email or by posting the revised Terms on the website. By continuing to access or use the Services after any changes become effective, you agree to be bound by the modified Terms.

3. Use of Services

In using the Website and/or the Services, you agree to the following:

1. Illegal Use: You agree not to use the Services for or in the pursuit of illegal purposes. Snap SEO co-operates with the authorities in investigations into illegal Internet use and will take both criminal and civil legal action against users who use the Services unlawfully.
2. Harassment: You agree not to use the Services for harassment, threats, verbal abuse, and/or persistent unwanted contact(s) of any kind, including but not limited to unwanted emails, chat messages, and defamatory information posted on websites.
3. Disruption/Hacking: You agree not to attempt to disrupt or hack our Services or those of any third party. This includes attempts to interfere with another user’s ability to use the Services, unauthorized access to hardware, and malicious attacks. Violators will face legal consequences.
4. Fraud/False Advertising: You agree not to post or transmit fraudulent information through the Services. This includes false advertising, identity theft, phishing, and forged email headers.
5. Unsolicited Advertising/Spamming: You agree not to post or transmit unsolicited material such as mass emails, chain letters, or advertisements. Snap SEO may limit the number of recipients for emails to prevent spamming.
6. Disruptive Content: You agree not to post content deemed disruptive by Snap SEO, including obscene or offensive material. We may suspend or terminate Services based on your content’s impact on the community.
7. Adult Content: You agree not to use the Services to post adult content, including pornography. We reserve the right to suspend or terminate your Services for violations.
8. Reselling or Reconfiguring Services: You agree not to resell or reconfigure the Services to allow third parties to use the Services for illegal or inappropriate purposes.
9. Weapons and Firearms: You agree not to post or host any weapons or firearms-related content, including the sale of parts or components, ammunition, or demo videos.
10. Copyright Infringement: You agree not to use the Services to violate copyright laws. Snap SEO respects intellectual property rights and expects you to do the same. If you believe your work has been infringed, please follow the process outlined under Section 10 of this agreement.

4. DNS Services Using Cloudflare

By using Snap SEO’s Services, you agree that we will be using Cloudflare as the DNS provider. Cloudflare provides enhanced security, performance, and caching services for your website. You acknowledge that Cloudflare’s terms of service and privacy policy will apply to you.

5. Cloudways and DigitalOcean

In addition to agreeing to these Terms, you also agree to comply with the terms of use and service agreements of Cloudways and DigitalOcean, our cloud hosting providers. By using our Services, you acknowledge that you have reviewed and accepted the terms and conditions of both Cloudways and DigitalOcean. Their respective terms of service govern your use of their infrastructure, and you agree to be bound by them as well.

Consent to Data Storage and Transfer

When purchasing Services, you may specify the geographic region, cloud provider, and jurisdiction in which your Services Content will be stored. You consent to the storage and transfer of your Services Content to these regions and providers, including Cloudways and DigitalOcean. Unless otherwise agreed in writing, Snap SEO may transfer your Services Content to other regions or providers at its sole discretion, and you warrant that this storage and transfer is permissible under applicable laws.

6. Account Responsibilities

You are solely responsible for the activity that occurs on your account, regardless of whether it is undertaken by you, your employees, third parties, or end-users. You are responsible for notifying your employees and anyone else associated with your use of the Services of these Terms. Snap SEO is not responsible for unauthorized activity on your account.

7. Termination of Services

We reserve the right to terminate or suspend your account at our sole discretion if we believe you have violated these Terms or engaged in illegal activities. We may also terminate your account for inactivity or non-payment.

8. Indemnity

You agree to indemnify, defend, and hold harmless Snap SEO, its affiliates, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including legal fees, arising from or in any way related to your violation of these Terms, your use of the Services, or your violation of any law or the rights of a third party.

9. Limitation of Liability

In no event will Snap SEO be liable to you for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services, including but not limited to loss of profits, data, or goodwill. Our liability for any claim arising out of or relating to the Services will not exceed the amount paid by you to Snap SEO for the Services in the six months preceding the claim.

10. Right to Access and Disclose Information

We reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) respond to any applicable law, regulation, legal process, or governmental request; (ii) enforce these Terms, including investigating potential violations; (iii) detect, prevent, or otherwise address fraud, security, or technical issues; (iv) respond to user support requests; or (v) protect the rights, property, or safety of Snap SEO, its users, and the public.

11. Copyright Infringement

If you believe your work has been copied in a way that constitutes copyright infringement, please provide us with the following information:

• (a) An electronic or physical signature of the person authorized to act on behalf of the copyright owner;
• (b) A description of the copyrighted work that you claim has been infringed;
• (c) Identification of the infringing material, including the URL;
• (d) Your address, telephone number, and email address;
• (e) A statement that you have a good faith belief that the use is not authorized by the copyright owner; and
• (f) A statement made under penalty of perjury that the information provided is accurate.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Alberta, Canada. Any legal disputes shall be resolved in the courts of Alberta.

13. Miscellaneous

These Terms constitute the entire agreement between you and Snap SEO. If any provision of these Terms is held to be invalid, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
